states under winter storm warnings right now. pennsylvania, new york, massachusetts, new hampshire, vermont and maine. all could see a foot of snow or more. more than 200,000 customers spanning several states already without power. 1,700 plus flights canceled yesterday. imagine that. hundreds more already taken off the board this morning. there are six deaths being blamed on the weather since tuesday and the threat hasn't passed yesterday. bonnie schneider, meteorologist checking the system from the cnn center in atlanta. first, we go to ennis standing by in miserable, snowy new york. it's a pretty picture, ines. >> reporter: you can still see the snowfall here. and this area is expected to get anywhere from 9 to 13 inches here in syracuse and in some other areas of new york, up to 18 inches. and i'll tell you that the snowplows have been working 12-hour shifts throughout the day yesterday and evening. they were spreading salt before the storm in anticipation of the storm. this area is used to getting a lot of snowstorm. two years ago they got almost 180 inches of snowfall. and so

the jeffries trading floor today in new york. peter, you have a lot of different scenarios, but the most likely scenario that you think is that the blackberry fails, there is no acquisition on this and the cash firm continues? >> yeah. we think it costs about $1 billion to launch these devices. if successful, we think an access possibility goes up. if not, we see the company become much, much smaller a year from now. >> how do you measure success? and when we we know on this? >> we'll probably know around around/may next year. success would be call it 3 to 5 million units in the first quarter out of the gate and 5 million units plus after that. to us, that would be a very good launch. >> for anybody who is actually a blackberry user still, what do you say about these things? if there's a takeover, does that mean blackberry continues? what's the long-term outlook for the company? >> i would suspect that if you're a blackberry user, there's very little chance that your service is going to be cut off. that is a key cash flow driver for the company and anybody who would want to buy isn't concerned

where your money is? hi, everybody, welcome back. i'm maria bartiromo on the floor of the new york stock exchange. markets closing higher on optimism that lawmakers may be close to a deal on the fiscal cliff. wall street, triple-digit gain, up 120 point on the industrial average. banks in the lead, 13,353. last trade in the dow jones industrial average on volume which was modest. nasdaq composite up and 3053 and the s&p 500 picks up 16 points, better than 1% on the standard & poor's at 1446. markets continuing higher at the close. are there more gains ahead? we bring in right now liz ann sanders from charles schwab and alan gael and eric steuben from russell investment, darryl pearl from epoch investments standing by who will give us a reaction to the oracle earnings once those numbers cross the wires. they should be coming out momentarily. here's the number to look for, 61 cents a share on earnings is what we're expecting on revenue of 9.02 billion. as soon as we get the numbers we'll see how oracle is doing. liz ann sanders, deal or no deal? what's your take on all of this? >> we'll ha

, in much of upstate new york, they've canceled preemptively the flights out of there for tomorrow and here's why. here is the big snow picture. kind of the snow sweet spot from cleveland through i-90 and in toward buffalo, rochester, syracuse, so it is all lifting to the north. the same storm that we have seen bring feet of snow elsewhere. so going a little bit closer, you can see very dark white is heavy snow, maybe 1, 2 inches an hour. and right along the lakefront, cleveland, erie, buffalo and points down. so i-86, i-90, i-80, i-80 tonight we'll watch the snow lift farther north and then driving perilous conditions tomorrow. really in upstate new york and western new york. and part of the problem is is that we thought thehave these i strong winds. right now indy gusting to 33 miles an hour. as far south as nashville, cleveland, as well, 32-mile-per-hour wind gusts. and that axis of winds is pushing into the northeast for upstate no, late tonight and really balance of tomorrow. in terms of the blizzard, there's the blizzard warning now. it's down to just a few counties. in north central

writes this in "the new york times." republicans have to realize that they are going to cave on tax rates. the only question is what they get in return. do you agree? >> not necessarily at all, because i believe if you raise the base upon which the tax rate is applied, you can raise revenue and keep the rates where they are. >> explain that. let me stop you there. when you raise the base of which the tax rate is applied, explain what you mean. >> capping deductions so you can't use deductions to offset tax obligations. that creates more revenue but the rates stay the same. as erskine bowles commission can go down as much as from 35% to 29% at the upper level. the same thing ronald reagan and tip o'neill did in 1986. in 1986 the top marginal rate it was 70%. it was lowered to 28%. we can take that approach again. >> you know, you brought up the fact that you are in real est e estate. one of the items that will be on the table is the mortgage deduction and one of the kr criticisms that the white house had, for instance on the boehner plan, is there were no details there on deductions. how

on a sleepy town in new york. this is how it looked around 6:00 in the morning today. there was a massive house fire that ravaged homes overlooking lake ontario. the house fire spread as firefighters tried to dodge gunfire. the firefighters apparently walked into a trap just as they were responding to this. at last word, two firefighters are dead, three other first responders are wounded, and alleged gunman is dead. authorities can't say whether other bodies might be found in the eight homes destroyed or damaged by the fire in the town of webster. shocking, bizarre, tragic today. cnn's poppy harlow is in new york, trying to piece together this horrible chain of events here on christmas eve. so what happened, because authorities are saying potentially this was a trap laid out for the firefighters. >> that's what the police chief gerald pickering said in the last press conference, we're awaiting right now another press conference that should start any minute. but he did say that it appears that possibly these four first responders were lured into what was a trap. it started at 5:35 this mor

, with the sort of patchwork vision of how this could work? because in new york, in august, there was a shooting outside the empire state building, and highly trained new york city police officers ended up wounding nine bystanders. doesn't that create also a dangerous precedent that's worth some concern and caution? >> no. because here's -- what's the alternative? 20 students massacred, six administrators, teachers? this is going to happen again and again and some people out there are trying to be thoughtful and say, well, let's restrict gun ownership or possession or the size and capacity of magazines, thinking somehow that this will improve school safety. it will not. and so, i'm trying to be realistic, is how can we do it, when you refer to new york city. some of the key elements in safety, in law enforcement officers are trained in this, and should be far more disciplined. and not to criticize these new york officers, but you always watch your backstop, in anyone this your environment, before you fire at anybody. and so, every police officer, just because we wear a badge, we're not superhero

. and there's already article. a "new york times" article today about michael cooper about what will happen with the gun debate. we've had sorts of stories written after abby gifford was shot. it seems like something has changed but maybe it's because of the moral obscenity that it's so past anything conceivable. and so, i wanted to trace for a moment, as we're thinking about where the white house is going to be on the. everyone is talking about the president, where the president has been in the past. what the trajectory of his stance on this issue is. he's moved in one direction and quite directionally without much wavering back and forth. as a young politician he was in the area of the country with some of the strictest gun safety regime in the country and incredible political constituency for that. he was a strong advocate. in 1996, when running for state senate illinois when asked, do you support legislation to ban the manufacture, sale and possession of handguns and he answered, yes." later a staff in 2007 of his campaign told politico a staff member had answered that question for him
